Multiple criminal defense lawyers see no crime in off-duty officer shooting

(CBSDFW.COM) – Dallas Police officer Amber Guyger’s arrest warrant has some North Texas legal experts asking the same question. “Where is the crime?”

Criminal defense lawyers CBS 11 talked to at the Dallas County Courthouse describe the Texas Rangers warrant as “weak on motive or intent.”

They believe it will be difficult for the Dallas County DA’s office to prove a crime.

The probable cause affidavit released Tuesday afternoon offers a detailed account of what happened inside Botham Jean’s apartment last Thursday night.

Officer Amber Guyger told investigators how she walked into an apartment she mistook for hers and shot the 26-year-old man thinking he was a burglar.

CBS 11 asked several prominent criminal defense lawyers what they thought about the warrant.

All of them said they were surprised they didn’t see words like “reckless” or “intentional” which they say would normally be found on similar documents in manslaughter and murder cases.

“It’s an interesting read,” said criminal defense attorney George Milner. “It doesn’t read anything beyond negligence of that they simply do not specify how she is reckless which is the required mental state for manslaughter. It reads much more like an accidental killing. I mean if someone were to drop a gun accidentally and it fired and it hit somebody.”

Milner and others say it doesn’t necessarily mean the DA’s office doesn’t have a good case because the investigation is still ongoing.

But he says it’s clearly a sign the Texas Rangers were careful not to implicate Officer Guyger.

“If it was a reasonable mistake of fact, that’s an affirmable defense that is going to weigh into this thing very heavily,” said Robert Hinton, another criminal defense attorney.

“In my honest opinion, I think if I represented her, she’d walk,” said Milner.

Meantime, activists and leaders in the Dallas faith community believe Officer Guyger should be punished.

This is a very tragic death a family lost their son all because a police officer went into a wrong apartment so she said ,,,how is that not a crime ?? she killed the guy in his own apartment minding his own business ,what if there were other people in the apartment would she have killed them all !! what if the apartment belonged to an elderly person would she have shot them as well !! what if there were kids around what would she have done then !! ......this police officer needs to be charged and take responsibility for her actions doesn't matter if she is white or black justice must be served a family is grieving unnecessarily because a stupid human being that went to the wrong apartment like who does that gosh she should be feeling guilty and just accept what happened get charged she murdered someone this is real life ,,,,how would these lawyers that are defending feel if this was one of their own ,if this was one of their relatives would they state that no crime was committed still and have the officer walk free ...come on !!!! black or white it does not matter this police needs to be charged simple and clear ,,,if not then anyone police or not can walk into a wrong apartment and shot what will happen then !!!

If it was Botham Shem jean had killed the wHite Police officer he would have been in prison and without no bail until the trials and he would have gotten life in prison or the death penalty but just because he is a young handsome black st Lucian man and he did not born their she has a right to take his life what is wrong with you God dam wHite people and the Dallas Texas Rangers his family and friends here in St Lucia and In Dallas wanted justice for Botham Shem jean OK so let that dam Police officer woman face justice and she supposed to get the death penalty .a young st lucia man couple months ago had murder a young woman over their in the USA and he did not get bail he is still in prison over in the USA wating for his trials OK so I am saying that what goes to one gose to all not because she is a dam Police officer woman and she has the right to tell the truth about what really happened she was not drunk or blind when she pushed the elevator bottom to go to the four floor and she passed the third floor and you all foolish Police officers and the D A is buying into her lies just because she is white.
