Judge says Ciceron rapist has taste for sex with minors and abnormal sexual activity

Dwayne Lamas James of Ciceron was yesterday, April 16, 2013 sentenced to six years in prison for raping a 14-year-old.

On July 6, 2009, the victim was reportedly walking near her home in Ciceron when she was approached by James who had a homemade firearm in his possession.

The court heard that the defendant forced her to accompany him to a galvanized shack near the beach where he sexually assaulted twice before releasing her at about 2:00 the following morning.

Following the incident, the victim, who lived with her grandmother, went home then was accompanied to the police station to make a report.

James had pleaded not guilty to the charge of sexual intercourse with a minor in February 2010, but in January 2013 pleaded guilty to rape.

The pre-sentence report determined that James had previous sexual contact with the victim in the form of a consensual relationship during which they cohabited under the roof of her grandmother. The report stated that the relationship was terminated because he had been violent toward the victim.

The report also stated that James was prone to violent acts, was easily influenced by negative behaviour and drug abuse problem.

According to the court, the aggravating factors against James were the violence of the crime, the prevalence of rape in society and the use of a home-made firearm to coerce the victim.

The sole mitigating factor was his early guilty plea which came three years after the initial indictment.

Justice Francis Cumberbatch stated that the defendant would still benefit from the reduction for an early plea as he was not represented by counsel in the matter.  He further stated, however, that James showed a propensity for abnormal sexual activity and a taste for sexual contact with minor partners.

With an initial sentence of 10 years for the offence, James will serve six years due to a reduction for his early plea.  He will serve this sentence concurrent with his sentence for possession of an unlawful firearm.

James is further ordered to receive counselling to deal with his sexual misconduct and his drug abuse.

He is incarcerated at the Bordelais Correctional Facility and will be credited for time served on remand while awaiting trial.

  1. Am I reading right?...he had a consensual relationship with the minor BEFORE she was even 14, and stayed at her grandmother's home???? So the grandmother knew about it? She was ok with it?...whatttt nonsense is this?Are u KIDDING me?!!! They should charge the grandmother too! Why are u allowing the little girl's "boyfriend" to live in with yoll???!!! She really didn't think he would touch her? Not saying he was right to rape her..that's totally wrong but whyyyyy did the Grandmother facilitate such a relationship in the first place??!!! Ridiculous!
