(DAILY NEWS) – A Florida woman was arrested for driving drunk with her young child in the backseat without a seatbelt, police said.
Deputies in West Palm Beach pulled over Brandy Lerma after another motorist reported a car swerving down the road with a child in the back unrestrained.
The driver who witnessed the erratic vehicle, Juan Martinez, wrote in his witness statement that he was worried Lerma was “going to kill someone.”
Martinez said he called 911 and then followed Lerma’s gold Chevrolet until deputies arrived. A deputy said when he spotted Lerma’s vehicle, she was driving in between lanes “occupying both the left and right lanes simultaneously.”
The police report stated that Lerma briefly entered the right lane and then crossed the lane divider once again driving in both the right and left lanes.
The deputy pulled her over for failing to “maintain a single lane.”
As the deputy approached the car, he said a small child was standing up on the backseat without any type of restraints.
Brandy Lerma was accused of drunk driving with her unbuckled child in the car on August 16, 2017 in Palm Beach County, Flordia.
“I immediately detected a strong odor of an alcoholic beverage emanating from her person,” the deputy stated.
“Lerma’s speech was also slurred and she was initially unable to locate the documents I requested from her despite the fact that they were plainly visible to me inside her wallet.”
Lerma was asked to perform field sobriety tests, but fell on the ground twice. A breathalyzer showed her blood alcohol level was twice the legal limit.
Deputies said Lerma informed them that she had “two fireball drinks,” along with Percocet, Xanax, a sedative and a pain killer.
She also received tickets for not wearing a seatbelt and for passengers younger than 18 years old not wearing a seatbelt.
Lerma was taken to Palm Beach County Jail on charges including child abuse and DUI. She was released on a $3,000 bond.
