“Clarification of U.S. position welcomed by Government of Saint Lucia” – PM Anthony

kenny-anthony-formal0PRESS RELEASE – The Government of Saint Lucia has noted the concerns expressed by the Embassy of the United States of America to Barbados and the Eastern Caribbean as detailed in its Press Release of January 12, 2016.

The Government of Saint Lucia welcomes the fact that the United States has clarified its position on the matter of the prosecution of those who are alleged to have engaged in extra-judicial killings during the tenure of the former United Workers Party Government, between 2010 and 2011.

The Government believes that the statement will better help the people of Saint Lucia and indeed, the officers of the Royal Saint Lucia Police Force, to understand the position of the United States in this difficult and complex matter.

Whilst the Embassy has quite rightly noted there has been no meaningful progress towards a criminal prosecution in the last ten months, of those who are alleged to have committed “extra-judicial killings”, the Embassy’s suggestion that this is or was due to inaction on the part of the Prime Minister or the Government of Saint Lucia is misplaced and unjustified.

The fact is that the Executive’s role in this matter was fulfilled upon presentation of the CARICOM Implementation Agency for Crime and Security Report to the Director of Public Prosecutions ten months ago, in March 2015. Indeed, the Director of Public Prosecutions herself publicly stated that she never read the report until a full six months following her receipt of it.

Up until the time that the DPP proceeded on pre- retirement leave, in December of 2015, she never requested the Government of Saint Lucia, facilitate her in interviewing the investigators whether in Saint Lucia or Jamaica.

To the charge that the Office of the Director of Public Prosecutions was not provided with the requisite resources to prosecute this matter, the Minister for National Security responded promptly and fully, debunking the DPP’s assertions. The issue about prosecuting those who may have committed alleged criminal offences has never been one about resources.

Firstly, the Government of Saint Lucia made provision in the Estimates of Revenue and Expenditure for 2015/2016 for the appointment of two special prosecutors to assist her to prosecute those who may have committed criminal acts, if she deemed it necessary. She never made use of these resources.

The truth is, that never in the history of the DPP’s office has it been as well-staffed as it was at that time, with only the position of Deputy Director of Public Prosecutions remaining vacant. Even then, the Government of Saint Lucia had placed advertisements in the local and regional papers to fill the position on several occasions. The Judicial and Legal Services Commission decided that none of the applicants were suitable to fill the vacant post.

It must be noted here that appointments to the positions of Director of Public Prosecutions and Deputy Director of Public Prosecutions are made not by the Executive but instead by the Judicial and Legal Services Commission, a body established under Saint Lucia’s Constitution which is, therefore, outside the purview and influence of the Executive Branch of the Government.

The Government of Saint Lucia remains steadfastly committed to the rule of the law, and remains as anxious as the United States of America to ensure that justice is done and the human rights of all of its citizens are protected in accordance with our Constitution.

But, as recognised by the Embassy itself, our Constitution guarantees the independence of the individual arms of Government. Consequently, it would be unlawful for the Executive to impose its will on a matter that is now clearly within the purview of the judicial arm of the state.

The fact is that the Executive has done everything which is within its constitutional authority. The Executive brought to Parliament legislation to allow for the investigations into the alleged extra-judicial killings to be undertaken by a body other than the Royal Saint Lucia Police Force.

It placed at the disposal of the investigating team all of the required resources, and once the report was completed, in keeping with the provisions of our laws to appoint the investigating team, it was passed on to the DPP. In pursuing justice, Government cannot itself be breaking laws. The Office of the DPP must, when it is properly constituted, be true to its mandate and prosecute this matter at its earliest.

The Government of Saint Lucia will continue to work closely with the Government of the United States to resolve these issues in the interest of ensuring that justice is served.

The Government of Saint Lucia expects that the Judicial and Legal Services Commission will soon approve advertisements to fill the vacant post of Deputy Director of Public Prosecutions and the post of Director of Public Prosecution when it becomes vacant, consequent on the end of the pre-retirement leave of the incumbent Director.

Our country really needs to bring closure to this issue.

    WHO CONFIRMED THAT IT WAS? DID HE OR ANYONE ACTING ON HIS BEHALF GIVE INFORMATION TO THE AMERICANS BEFORE ALL OF THIS STARTED?

    IF THE @REPORT IS SO EMBARRASSING TO THE OPPOSITION WHY IS HE STILL WITHHOLDING IT IN ITS ENTIRETY FOR THE RELEVANT AUTHORITIES AND EVEN FROM THE OPPOSITION?

    AND WHILST WE ARE AT IT PLEASE ALSO ANSWER - WHAT IS THE DEAL WITH JUFFALI? WHO WAS SENT TO ENGLAND?

    WHY IS THE MINISTER OF FOREIGN AFFAIRS SO SILENT ON THIS MATTER?

    WAS HE AWARE OF JUFFALI'S APPOINTMENT?

  2. So whats wrong with that? If St.Lucia dont charge and prosecut them bad apples in the RSLPF they will think that they are above the law. All police forces have some dirty cops we must make an example outta the bad ones. America dont need our support we do. So Mr. Prime minister do the right thing on behalf of all the families who want closer for their loved ones.

Really.

    As far as I am concerned the Minister's response to the DPP saying she was short staffed and barely able to deal with the 'Ninja Dan' case was not convincing. Repeating that you offered her two special prosecutors for IMPACS doesn't change the fact that she had been short staffed for the entire year and couldn't put pending murder trials on hold any longer.

    In the Court of Public Opinion the DDP sounds more convincing than the Minister of National Security right now.

Well here is a précis of what the PM has said in this statement: "It is the UWP's fault that these people were killed during Operation Restore Confidence. It's the DPP's fault that no one has been prosecuted to date. My government has done everything correctly and is blameless in all this".

  7. Is it Kenny or tony complaining about the DPP?

    The fact is that under the SLP's various administrations the public institutions of St Lucia have allegedly all been hollowed out , become ineffective and nonproductive or politicized for the benefit of the ruling party.
    The Police Force, min of health, comm and works, Parliament etc have all become useless tools of the St Lucia Labour Party. Efficiency and productivity are non existent in spite of the fact that billions are spent every decade in running these institutions.

    St Lucians have just accepted this incompetence and now the PM has the gall to bring up separation of powers when we all know that in St Lucia the government determines the effectiveness of all public institutions depending on whether or not these institutions benefit their political agenda.

    Under the political focus of Kenny Anthony and Phillip Pierre et al , St Lucian institutions have allegedly been allowed to rot and decay. The only reason we do not smell the putrid mess is that the SLP are masters at keeping the facades up and the smell from seeping out.

    Over 500 St Lucians have been murdered while various SLP administrations have ruled this land ineffectively. Family life has been destroyed with a now world leading 86% of children born out of wedlock most to single mother households.

    Walk the streets of St Lucia to see the decay in our values and see the hard faces expressing the economic degradation of our society.

    And while St Lucia burns , Kenny and Co play the proverbial fiddle and concentrate on their own self aggrandizement.

  8. Let us look at the facts as with his usual 'Jekyll and Hyde' , Kenny and Tony personality the Prime Minister cannot differentiate truth from fiction.

    This is an individual who spends 24/7 in obsufcation and twisting facts to suit his world view.

    It was the SLP whose operatives allegedly threw St Lucia under the bus by going to the US Embassy in the first place to politicize the alleged extra judicial killings.

    If there were these killings it is a serious cause for concern but do not come now pretending this does not have your dirty paws all over the issue.

    This is also the same J and H govt that has had negative growth for 4 years that sabotaged the Lucian economy by asking investors to abandon St Lucia during the previous UWP term of office.

    Kenny is pathological incapable of positively managing the St Lucian economy because every decision he and his cohort of slackers make is based on their political and economic self aggrandizement and not the welfare of St Lucians.

  9. I have see a lot of comments stating that the United States should look into their own affairs and not st Lucia. The question is when one of your love one is kill, you want Justice. The United States is the one taking care of the training of the marine unit and supplies them with all the gears necessary for protecting our land. The United States takes care of training for members of the police force so when we talk about why the United States is involved and not taking care of their own crime think twice they surly do to the best of their knowledge. We talk about there is no justice in the country, we talk about corruption in the police force and when we getting aid from the United States we crying fowl. What do we St Lucian want?

Furthermore the USA not in any damn position to demand action. I would tell them to check on the 388 victims of police shootings in Chicago where only two were deemed unlawful. I would also ask them how many citizens were killed in Jamaica during the capture of Christopher dudas coke a few years ago..........75. How many innocents were killed by the US in Iraq???? 100,000 or more.

  13. Here we go again. More crap, distraction, confusion, and ducking, all designed for local consumption. Despite all the smoke screen and mamaguy the material facts of this issue will not be changed. Kenny will learn to eat humble pie and accept responsibility. All the nonsense about us being a sovereign country did not seem to matter when he was bawling out from the top of the pitons for anyone and everyone to hear and strangle St. Lucia.

    When he tried to sabotage the island's economy by vowing to contact any potential investor in order to dissuade them to invest in St. Lucia he had not a damn care for the repercussions. Whether he did or did not it was still in the international media and social scene traveling around the world at Facebook speed.

    Kenny has inherited what he precipitated and now wants to blame everyone else for our demise which he is now faced with fixing.

    The US is not buying the whitewash; neither are the Europeans; neither the French nor the British. Why doesn't he tell them to mind their own business? His tail is between his legs but he will come and shoot all kinds of gwen to the local populace as if we have air in our heads.

    Kenny needs to stop this doublespeak and hoodwink talk only designed for local consumption. Pandering to the hacks and party faithful who will drink the KoolAid grasping at any straws they can find to justify their existence.

    Kenny can say whatever he wants, blame whoever he wants, he can roll and tumble, bawl like a cow, say whatever he wants, there is nothing he can do other than deal with these situations. Nothing will stop this runaway train which he himself has released down the tracks.

    Stop the foolishness and take your licks. His minions and brown nosers can spin it all they want but nothing will change for the final outcome. Will he compromise further the IMPACS report by uttering more half truths and unverifiable tidbits? The passing over to the DPP was a travesty and as a supposed constitutional lawyer he made a mess of it. Inept and maladjusted to the task at hand.

    Propaganda will not change the facts and neither will it change the horrendous persona that you have imposed in yourself upon St. Lucia.

    Ultimately you, Sir, are responsible, and consequently must accept the blame and sanctions for what you have failed to deal with under your watch. The same action you called for while in opposition you have failed to deal with yourself.

    En rouge. En rouge. Blood in our eyes.

    Where are the better days you promised the faithful? If these are the better days you promised there shall be no mercy for you this election year.
