Guy Joseph files injunction against Boundaries Commission

Guy Joseph.

Parliamentary Representative for Castries South East Guy Joseph has filed an injunction in the High Court against the Boundaries Commission, which recently approved the realignment of constituency boundaries.

The action, which was filed on February 17, 2015, seeks to restrain the governor general, through the attorney general, from making any order or proclamation for a period of 14 days.

In addition to the Boundaries Commission being named the first defendant in the action, the prime minister and the attorney general are named second and third defendants, respectively.

The matter will be heard on February 27, 2015 at 9 a.m. before Justice Frances Belle in the High Court.

There has been a number of debates regarding this issue. While some persons believe that the realignment is long overdue, others have questioned the urgency of making provisions for additional  constituencies.

Some persons have also said the country cannot afford it now. However, others have said that by whatever means the country must adhere to the recommendations, in order to better serve the people.

The Constituency Boundaries Commission has recommended that the number of constituencies be increased from 17 to 21.

The Commission recommends that Gros-Islet to be divided into three constituencies and  a new constituency be created by conjoining contiguous parts of Babonneau, Castries North and Castries East to reduce on the size of those constituencies.

It also recommended that a new constituency be created from Castries South East and Castries South, to reduce on the size of Castries South East.

  1. The first defendant is the Boundaries Commission. Two of the five members are poe-toe UWP. Is this not a case of UWP suing UWP?

  3. The strategy is clear. Harass the government in the hope that luck will turn up an issue with momentum.

I have thought about this boundaries increase cost nonsense. And as far as I can tell, UWP and LPM are being hypocritical.

Are they really concerned about the cost? If are, why are they not they tabling an amendment for the government to reduce MPs pay by 20% until the economic condition improve?

That would make the changes cost neutral. But the hypocrites don't care about Saint Lucia. They just want to create confusion even as we celebrate our 36th anniversary of independence.

  5. People don't let Kenny trick St. Lucians again, mate is very educated and realizes that if he increases the number of seats on the island hi might have a better chance of being re elected to giving us better days.

    Bravo Guy, respect.

  9. First thing to consider is on what grounds the injunction is sort. This information is critical to St. Lucians to understand the varacity of the claim and appreciate the piont. Without that all kind of insane comments such as "Who Guy think he is,""jackass joseph" uniformed ones like "bus driver to a politician" and "they had representatives on the Commission" will dominate the boards. This type of comments makes everyone look so stupid and ignorant. With no one offering a reason why they think that Guy is a "jackass" or was "bus driver." I think that public discourse should be taken to a higher level. For if we cannot have civil and intelligent discussions why should our politicians and the resulting policies be any different?

This is the same method that the politicians feed garbage rhetoric to uninformed people (majority) to drown the reasoning of intelligent persons (minority). Even though the opposition was represented on the Commission do you think that their opinions were fully taken into consideration in the formulation of a final report? Lets endeavor to find out the facts then consider whether it has merit.

  10. I am in agreement with the increase in the number of constituencies, because some are too big in populous for one person who also has a ministry to handle. The time of the increase is bad, these adjustments takes time that people are familiar with where they will be voting. Another way of resolving the constituencies issue is like what Richard mentioned. Establishment of local government, which will be controlled by the parliamentary representative and leave the central government up to people who are qualified in particular fields to run, and is overseen by the prime minister. There for politics will be reduced in the affairs of the central government.

  14. I may not particularly like the guy, but if a Rat crept out of the Sewer and claims to be a representative of all the Rats, I would fight like hell to give him the right to represent the hell he wants to. You A - B look down your nose at the guy who was a bus/truck driver, and feel he is not worthy to be a man; let me tell you, in my eyes, he is a better man than most.
Where are today's Statesmen: men like Sir Garnet Gordon, Sir Grantly Adams, Bradshaw, Eric Williams, Carasco, Manley and John Compton just to name a few. These men earned my respect and the respect of a whole lot in the Caribbean, they proclaimed a democracy that I live by.
But sadly the focus today is on fame and fortune. St.Lucia will survive this, because I still believe there is a remnant of goodwill among the people. Some can only fool the people - just for a little time.

    • i agree with you my partner, that should be the beauty of democracy;irrespective of your ward in life, once the people feel that you can better represent them then you should get the job. unfortunately you have seen the creation of the educated class who believe that only people as certified or more certified than them are worthy of leadership simultaneously you have seen a drop in good governance, rise of poverty, increase in violence and a general state of despair among the citizenry.as an educated person i say give me better leaders/doers/innovators irrespective of their educational level.

  20. from what I understand, Guy Joseph is he only one from the Opposition who can file the case because he is directly affected as a sitting MP. King would not dare do that to Kenny. So let us really see what the evidence says and who will have the last laugh! Over to you AB, laugh now, cry later

  21. If the representative of your party on the commission approved the recommendation then what really is the issue. This clearly shows the lack of preparedness govern as internally the UWP should have discussed this and addressed the issue prior to agreeing to the changes. Mr Joseph the country not being able to afford is not a reason for something not to be enacted. The same way we not being able to afford more judges is not reason enough to keep people on remand for so many years.

  26. From a bus driver to a politician.
He has finally got a career to rub shoulders with the MEN of this world.

His Boss is footing the bill.
But his Boss is staying in the shadows.
Because he knows that SLP will have a good laugh (because Guy Joseph will obviously lost this case) and this issue will be used to ridicule and taunt the UWP until Election Day.

    Good Move Guy.
    See you in our comic-strips.
I will be watching you on my Jumbotron. 🙂

    • such ridiculous comments, they don't make any sense you should remain quiet. The number one problem in St.lucia when people stand up for what they believe in because of ignorance we laugh and as a result the politicians just screw us blindly.

      (0)(0)
    • From bus driver to politician shows that the man has ambition, a quality that we try to inculcate into our children so stop trying to belittle it. Further, men died centuries ago to ensure that everyone (rich and poor) can achieve anything once they work towards it.
I really hate your caste mentality; get modern, it is 2015 you obsolete abacus!

      • Ask Denzil Douglas what the Privy Council told him them you will know whether seeking an injunction shows ignorance of the matter.

Dictators always seek legal ways to stay in power; go review how Hitler legitimately gained and maintained power.
