Barbados: Man gets ten years for having sex with mentally challenged teen

(BARBADOS TODAY) – A St Michael man has been sentenced to ten years in jail for having sexual intercourse with a “mentally subnormal” teenager and raping her.

However, Leonard Rupert Clarke, of Martindale’s Road, has already spent 2,145 days on remand at Dodds prison.

Therefore, he will only have to spend the remaining four years, one month and two weeks of his jail term.

On October 3, 2010, the then 18-year-old girl was walking near the Queen Elizabeth Hospital when she met Clarke, who took the minor behind the old Ministry of Health building were he had protected and unprotected sex with her.

Five days later he had another chance encounter with the teenager, but this time he proceeded to have unprotected sex with the girl, despite her refusal.

On his arrest he reportedly told police that he had realized that the teenager was disabled and had the understanding of a 13-year-old.

“While there was no evidence . .  . of violence used . . . in the offence, certainly the fact that you pursued the [victim] shows a level of predatory and reckless behaviour,” Madam Justice Jacqueline Cornelius told Clarke as she delivered the sentence in the No. 5 Supreme Court.

She also pointed to the significant age difference between the two, saying as the older one “he should have known better”.

Clarke, who is known to the court for robbery, criminal damage, theft and assault, had previously apologized for his actions and asked to be given a chance.

However, the judge maintained that his crimes deserved a custodial sentence.

Clarke was therefore slapped with a six-year prison term for having sexual intercourse with a mentally subnormal person and a concurrent ten-year jail sentence for rape.
